On Friday (04), the Supreme Court (STF) maintained the decision authorizing the sale, by Petrobras, of oil blocks without bidding. The decision was taken by a majority of six votes to four in virtual plenary. The decree, initially by then-President Michel Temer in 2018, regulates exploitation rights by the state.
The Workers' Party (PT), requested action against the decision, and in December 2019 had the request met by Minister Marco Aurélio Mello, rapporteur of the action. Less than a month later, Minister Dias Toffoli, president of the Supreme Court, revoked the injunction at the request of the Union.
Ministers Alexandre de Moraes, Luiz Fux, Luís Roberto Barroso, Gilmar Mendes, Cármen Lúcia and Dias Toffoli were in favor of the decision. Against, the rapporteur, Marco Aurélio Mello, according to whom the decree is incompatible with the Federal Constitution. Along with him, Edson Fachin, Rosa Weber and Ricardo Lewandowski.
