The judgment of the decision suspening the new rules of division of the Petroleum Royalties was scheduled for November 20 this year. The decision was defined by the President of the Supreme Court (STF), Dias Toffoli, relying on all the ministers in plenary. In Addition to this action, the STF will also have to determine whether or not the changes foreseen in the Law are approved.
The Royalties Law was sanctioned in 2013 in the Dilma government, but was suspended by the Minister Carmen Lúcia arguing that "the Constitution guarantees the royalty as compensation to the producer and that a new law cannot harm the right acquired by the producers", ie The change would cause a redistribution of dividends and participations to non-producer states and municipalities, but would decrease the value for the locations where there is extraction and production.
