Royalties: municipalities come out of the secondary production zone

The SPG (Superintendence of Government Participations) together with the collegiate board of the ANP (National Agency of Petroleum, Natural Gas and Biofuels) decided that only four municipalities of Rio de Janeiro – Guapimirim, Cachoeiras de Macacu, Magé and Silva Jardim – should make up the ZPS (Secondary Production Zone). The municipalities of Miguel Pereira, Vassouras, Paty do Alferes, Rio das Flores and Nova Iguaçu were unsquared from ZPS.

In 2007, the municipalities of Miguel Pereira, Vassouras, Paty do Alferes, Rio das Flores and Nova Iguaçu were transferred from the Secondary Production Zone to the Neighboring Zone. The change led to a decrease in the amounts passed on by royalties due to natural gas production. At the time, two lawsuits were initiated and it was decided that the ANP reopen the administrative process for expertise.

In practice, the royalty amounts due in the ZPS instead of being divided between the municipalities of Guapimirim, Cachoeiras de Macacu, Magé and Silva Jardim, would also be divided among the other five, totaling nine in this distribution modality. However, after further examination, it was decided that only the four municipalities should make up the ZPS.
